Penalties
An underage driver with a BAC or 0.01% or higher can be convicted of a zero-tolerance offense, which is an infraction. The penalties for an infraction are fines up to $250 and a minimum 1-year license suspension. An underage driver with a BAC of 0.05% or higher can also be charged with an underage DUI and face a similar 1-year license suspension. Likewise, he or she can face a fine ranging from $100 to $300. Those who are at least 18 years of age must also complete an alcohol education program as a condition of license reinstatement.
A zero-tolerance offense won’t add points to a driving record, but an underage or standard DUI conviction will lead to 2 points being added to the person’s record. Too many points can lead to a license suspension and will likely increase the cost of the person’s auto insurance.
